    Train horn legality

    I have a friend who has a true train horn on his truck, air compressor and all. It isnt wired into his regular horn, but on its own seperate switch and circuit. He normally uses his regular horn if he has to use the horn, but occasionally uses the train horn for idiots who are doing things like swerving into his lane and not responding to the regular horn. My question is, are trains horns legal on a passenger vehicle, and would you issue a citation for one?

    i have cited for those train horns. in florida it's 316.271(2)

    You will have to check your local statutes but in all likely hood.....No, they probably are not legal. I have written dozens of tickets for those horns and positivly despise them. Usually when I caught someone using one I would find multiple other infractions and would hit them for every one. I REALLY hate those things.

    Note to self: Miami-k9 REALLY hates train horns on vehicles. Tell your friend to stay out of Miami.

    They are illegal to use in TN. Excessive noise, also can just riding around honking a horn either.

    I'm thinking something as obscene as that is gonna end with an actual arrest for DisCon (Disorderly Conduct) for excessive noise, and then the vehicle being towed at owner's expense unless there is another licensed driver right there at the scene.

    You want train horns to be distinguishable and easily recognized as such, you do not want them to be something folks start hearing except when a train is following.

    I have no problem writing them.

    We only have 1 set of tracks going through town. I should mention that the horns are never really used for fun, but more when people start coming over into his lane, or if they almost pull out in front of him, which puts his life in danger too, and the horn lets them know he is there. I know its hard to hear a regular horn on the freeway doing 65. So it seems the general concensus is illegal. He never uses it around cops anyways though, as it only draws attention to him. I wouldnt get why a horn would be an arrestable offense though.

    To "get it" you need only look one post above yours. Pretty much spells it out in black and white.

    Let me break it down further. When people hear a train horn, they pay attention. That's the desired effect as trains are generally bad to collide with.

    Further, when people hear a train horn coming from an area which shouldn't have a train, they tend to freak, as demonstrated in the above posted video.

    Your friend using a train horn in this manner is more likely to cause the other driver to lose control of his vehicle, not to simply take notice of your friend.

    It's very simple really. Your friend is not driving a train. The use of that type of horn (which can cause panic when used in places there shouldn't be a train) is a very unreasonable use.

    Not only would it be arrestable here but let me give you another little scenario.

    Your friend gets ****ed off that someone just cut him off (come on, that's really the reason behind this, right? You can be honest...), or he is simply "warning" someone of his presence. Blasts his train horn. Other driver totally freaks out thinking he needs to avoid a train where one should not be, momentarily loses control by grossly overcompensating, causes major accident, and someone dies.

    Can you say negligent homicide (at best) and possibly even manslaughter (I think a case could be made for such actions being reckless) at worst.

    P.S. This is about as reasonable as using a paintball gun on full-auto to "get their attention" and "warn them of your presence".

    You wouldn't cite for them? Others have mentioned the obvious safety issue but what is the point in scaring the living crap out of somebody just for the heck of it? These horns are picking up in popularity here. Not only put on a vehicle just to annoy but to downright scare the living crap out of somebody. I'm all for having fun but causing people to panic while operating a motor vehicle is not my idea of fun.

    The laws were put in place not to keep from annoying police officers, but rather because the public finds such them unacceptable. Videos like those posted below are a perfect example of why they should be illegal. Ear drum damage, triggering heart attacks or asthma attacks, its effed up and shouldnt be done. Train horns are loud because they have to be heard for miles. Should the horn on your truck be louder than the siren on your patrol vehicle....I think not.

    Thankfully the train horn fad has, for the most part, faded here in miami. I still see a few and hear them occasionally. I believe aggresive enforcement has cleared up alot of it.

    JC Whitney has sold them, along with "cruise ship" style horns, for at least a decade and probably several decades.

    I wouldn't mind semi-style air horns on my Goldwing, but train horns are a bit much.

    I use to have one. I got stopped only once for it. I didn't get cited. I was using it when the Miami Heat had clinched the division and were going to the finals. There were a bunch of train horns going off that night, it's a common thing here in Miami. If you have a big truck (ex:F350) most of them put train horns in them.

    Now I completely understand why they're illegal. Perfect ex:
    One day I was driving thru a major street during the afternoon rush hour. There was some train tracks up ahead. Some smart *** decides to blow his train horn right before he's crossing the tracks. Everybody freaked out, including me since I was right ontop of the tracks when he blew the horn!

    I ended up getting rid of it because it's not worth the money when you barely get to use it. Plus every time you get to use it you have to looking out for any cop cars.

    California Vehicle Code section:

    27000. (a) A motor vehicle, when operated upon a highway, shall be equipped with a horn in good working order and capable of emitting sound audible under normal conditions from a distance of not less than 200 feet, but no horn shall emit an unreasonably loud or harsh sound. An authorized emergency vehicle may be equipped with, and use in conjunction with the siren on that vehicle, an air horn that emits sounds that do not comply with the requirements of this section.
