    Forced resignation...where to get help?

    I need some advice for help. I was just forced to resign and i believe that it was pre-emptive by the chief due to cases I was working on. There was a time that my wife and I were at the brink of splitting so I did something very stupid, I placed a ad on a web dating site. It was thru a radio station, nothing pornographic was allowed anywhere on the site. Well, I placed it, we stayed together and I being a dumb *** neglected to remove this ad. Jump forward now to last week.... I get called into the office and shown the ad which had been found by the mayor's daughter. I was told the ad needed to be gone, so I removed it. The chief then asked me some questions about my wife and i that i refused to ask. After talking to him, I went and removed the ad. Next day I get called in and told that I could resign or be fired. I asked why, was told because a police officer can never have a personal ad, and when I deleted the ad I used the office computer. I asked the chief why it was wrong for me to use the office computer for that, he told me he wanted it gone. Plus I then asked why it was ok for him to do his income taxes on the office computer.
    Now my cases...this was brought to my attention by another ocfficer here. I had 4 drug cases ready to be filed. I was not allowed to file them, also no other officer was allowed to know what or who I was working on. For example, I found meth oil in a local businessmans truck in November 2004. Kept being told that we needed to just wait and see by the chief. I also had two trash pulls on back to back weeks in which I found over 20 roaches, a huge amount of seeds and stems, etc... Again I was told to keep it to myself and just wait.. There has not been a drug arrest in the over a year I have been here.
    This was the first and only complaint I have ever recieved here.... was this a too strong penalty for my offense? There is a lot more happening that would be too lengthy to go into here.... where can I go for help? Thank You

    The personal use of the computer would probably only merit a verbal or written reprimand unless you were using it to view hardcore porn or for something unlawful.

    You have absolutely no idea why the Chief did not want to pursue those Drug investigations? Do you work in a one horse town where everybody knows one another? Are you inferring that the suspects in these drug incidents are politically connected and are friends of the Chief?

    More objective details are needed here.

    You should not have resigned. The only reason he forced you to quit because he knew he could not sustain a firing. As far as the ad, I think that would fall under the first amendment.

    Based on the conversation you had with your chief, and the resignation request, I'll be blunt. Unfortunately I'd say You're toast at that agency even if you are allowed to stay.

    Signing the resigination cooked your career there. Forcing them to fire you would have cremated it...................
    So enlighten us with the details rather then just your side.

    Yes, it is a small town. There was no porn or anything like that involved. The chief asked me questions about my marriage and wife that i said were none of his business. ****ed him off. As to the drug cases, I don't know why he wont pursue them. The meth oil was found ina truck that had driven thru a light pole and been left. Later I got a confession from the owner that he had been drunk and left the scene, no charges have yet to be filed even on leaving the scene of a accident. I do not want my job back... not here! I have spoken to an attorney about all the facts, sorry but it would fill a few pages, and he says I have a federal civil rights case.... My question for help is this. Are there any places that offer assistance financially for this type of problem? My wife cannot work because she is disabled and I was working for under 11 a hour. I am at least now working part time for another agency, I told the chief there what happened and he had no problem putting me to work. Any help would be appreciated, point me in a direction for help. I did something dumb, but it seems to me to be a issue between me and my wife.

    Though I'm not a lawyer, and based solely on what you've written (not knowing the chief's story) it seems like a pretty good civil rights case.

    What kind of financial assistance do you want? If you want help suing the town, the lawyer you spoke to can refer you to someone who will handle it on a contingency basis. Otherwise, I doubt that there's financial help out there. Churches and support groups for the disabled would be good starting points, though.

    In my opinion, they would have had to FIRE me. For 2 reasons.
    1. law suit
    2. unemployment insurance.
    Even if you were on probation, they still neesd a reason, such as past write ups, memos, charges.....otherwise discrimination plays a factor.
    The fact that you resigned means you quit on your own and you have no possible way of getting back unless you are civil servants and you would have to check those rules and regulations. Other than that, get in contact with your union, lawyer or other professional to see what could be done.

    call a lawyer. thats the most effective way to get things done in your situation. if he says you aint got a case, start looking for a new line of work.

    unless i missed something, did you register and place your orginal ad on the dept computer while on duty? if yes, you could be in trouble.

    if not,and you were ordered to remove the ad,and you did it on the dept computer and no one told you that you could not remove the ad on the dept computer, you stand a better chance of being ok..

    Even if he sues and gets his job back, he's through. He'll go nowhere under that Chief.

    I would suggest you go to a good labor lawyer. If you don't know one, check with an FOP member if there are any around your area. If not try contacting the National FOP throught the web site, they might have a list or someone out in that area that can reccommend an attorney.

    Otherwise start looking for a job and expect to have to go through a lot of shoe leather because you are probably never going to get a good word about your job at the old one.

    Short of commiting a serious crime or gross incompentance it is very hard to fire a cop in Ohio. Get fired and there is recourse that will probably get your job back unless ypu did something bad. "Quit" and you have no recourse other than finding a department willing to hire you or looking for a new career.

    i would never accept a questionable request for my resignation. as everyone else has said, you lose any appelate process the agency has. i think you just got bluffed into quitting.

    and a good example of why a police union with legal assistance is a good thing.

    Kansas is a right to work state, which means anyone can be fired for any reason. There is really no diffferece between a forced resignation and a firing. I attempted to fight this thru the cities process. It is laughable, to file a appeal yuou must submit a request to your dept. head and he must approve it. he did not, and I was refused my request to appeal to the city council.
    Answers to othyer questions, I have never recieved any reprimand or any complaint. The only things in my file are a letter from the secret service thanking me for help on a case and another from a family thanking me for helping with a unattended death in their family. I have spoken to a attorney and was told that fire/ force resign makes no matter here. He wants to file a federal suit for civil reights violations. I just need to know if there is anywhere that might help with the finicial part of the attorney. Kansas has no at large FOP lodge so I am screwed there.
    And one final event from today... My wife has MS and a couple days before this happened to me she got notified that her disablity was going to be reviewed. Today we found that the SSA recieved a call saying she was abusing disability. They are required to tell us were the complaint came from, and we were told that it came from a "law enforcement official" in our town..
