I got it that they found misconduct since the standard is only a preponderance of the evidence. It's the recommendation I am shocked with.
I would guess they expect him to serve as a warning to others.

I agree with Ex army mp....I seriously doubt he gets a OTH...I have even seen a CM a few weeks ago where the guy was found guilty of Battery on a minor and will be getting a OTH, even though the Govt wanted a BCD, so this fool will more than likely get a Honorable but coded as a Non-reenlist. Too much political BS surrounding this case and for a OTH would cause a bigger poop storm.

Just to be clear, a BCD and an OTH cannot be on the table in the same forum.

A BCD is a punitive discharge. A court can only give a punitive discharge, BCD or DD, or no discharge at all, no matter what branch of service.

After conviction, assuming he's not kicked at a CM, he'll likely received an admin separation board and there he can receieve OTH.

But Bearcat is right that different branches hold their service members to different standards. I just did a CM and an officer elimination board this week. Both of my guys got retained. Then again, it may not be the difference in services, it may be that they had a good lawyer

True but like I said with the political games being played all around, I dont see this guy getting a OTH. He'll get the Hon. with a coded Non-reenlistment tag....Theres too much visibility on this issue for the uSMC to drop kick this idiot with OTH.

I don't see a General backing down after a panel of (3) recommended this..... USMC works in a whole different way than the Army does......

He's gonna get a OTH and out the door he will be going this week or next. You can count on that.....

I didn't the board would vote for an OTH but they did.

With that said, even in the Army it's almost unheard of where a CG goes against a board's findings.

Nowadays it's getting even harder. I have gotten guys retained a year ago who would get booted in this environment.

Of course, the Marines are different. Unlike the Army, I doubt they were letting in sh*t bags who they otherwise wouldn't have let in. Thus, no need to now do massive cuts. I could be wrong, however.

Stupid freaking idiot. All the guy had to do was keep his mouth shut. Not even disciplined enough to do that. Oh well. He deserves to get booted and I feel ZERO sympathy for him.

He will probably join some occupy protest and try to make himself a martyr for free speech. Stupid Stupid Stupid. All he had to do was keep his mouth shut.

Even junior Marines know there is no such thing as "free speech" in the military. At least not the kind of uninhibited expression available to civilians. They also know there is no period that's "off-duty" for them. Marines are Marines 24/7/365 and are expected to abide by the established rules at all times. Just because your section's work day is over doesn't mean all the customs and courtesies associated with membership in the Corps end when your cammies come off.

As an NCO, Sgt. Stein knew better. His actions likely influenced junior Marines who look up to NCOs for leadership and guidance. This reflects poorly upon himself and on the Marine Corps.

    See ya...wouldn't wanna be ya.

In the Army, they are starting to take a USMC stance on alot of wear and appearance issues. Such as more strict haircuts, uniform appearance and even what you wear in Civies. Its definetly going to get worse for some folks.

Not sure I get the E-3 part. In the Army when one is discharged with an OTH he/she is reduced to E-1.
