If you, on duty, were involved in a departmental accident with a citizen (100% your fault) - NO DAMAGE TO EITHER VEHICLE WHAT SO EVER, and citizen doesn't care......and they came back suspended...
After reporting the incident to your supervisor...
Would you just smile and realize why they're being so nice about the entire thing and look the other way? :p

I'd be nice let them off with a citation, and give them an opportunity to call a licensed driver to pickup the vehicle. (instead of jailing them and impounding their car) ;)

Report it, have Highway Patrol respond for the crash report, cite the suspended driver, notify my sergeant. What's to say that the other driver won't come back in a couple days filing a claim for a neck injury? I'll take my lumps - all I will get is a letter of reprimand.

I would not cite the driver as the driver was kind enough not to claim any injuries. I would let him go. :eek:

A crash requires a "harmful act" either bodily injury or property damage. Without one or both of these there is no crash to report to anyone. In this scenario all you have is a random encounter with a suspended driver. I'd cite.

NO DAMAGE TO EITHER VEHICLE ? NOT AN ACCIDENT AS FAR AS NEW YORK STATE LAW IS CONCERNED. NO REPORT NECESSARY OR EXCHANGING OF INFORMATION.

If it happened to me I would have no problem taking responsiblity for the collision but I would also cite the other driver for being suspended and impound their car for thirty days. My poor decision that caused a collision does not make it okay for them to drive suspended.

In actuality whether its damage or not, we are required to produce a report in reference to the 10-50. To prevent things such as this. If the driver does not initially claim injuries, the report will reflect this.

Wash your hands of it - just sit there and request an outside agency if possible to investigate, cit, not cite, whatever.
Take yourself out of the picture other than as a motorist. DO NOT try to cover it up or erase it. Step up and own it - just detach from investigating or enforcement in this case.

:confused: Let me paraphrase. You are asking if we were to be involved in a two car accident with no damage and the other person doesn't want anything done about it would I let them go on a suspended license charge?
If I were to handle a call like this the person suspended would go to jail. No kidding they are being nice. They knew they should not have been driving. Had they not been driving it would have been real difficult for this accident to have occured in the first place.
On a side note I have never handled a two car accident in which there was no damage.
Hypothetically if this happened 70 minutes before the end of my shift I would hypothetically have overtime.

Maybe you can call my Chief and explain the rules.
We do an accident form {old one} for ANY non-reportable type crash and obvious the new forms for injury or tow required.
Even if its a parking lot fender bender we do a crash report:mad:

If some contact is made, even while it's NOT a crash as NO HARM WHAT-SO-EVER ... I'ld still call a supervisor and let him document it ... Would you just smile and realize why they're being so nice about the entire thing and look the other way? :p ... and then I'd probably write out the UTS for driving suspended.

first of all if I bumped someone and got out we both saw no damage why would I even ask for thier license? I would say sorry and be on my way. no damage equals no accident. I cant tell you how many people bump bumpers in parking lots and then want a report when there is no damage...sorry no report from me.

If I were to bump a car when on duty and there was no damage what so ever to either car, even if the guy that I hit was being very polite and seemed honest, I would still call my supervisor immediately and see how he would want me to handle the situation. No matter what the guy would be cited for DUS. As for the bump, by law its not an accident so I would handle it however my supervisor suggests.
