NEW YORK (CNN) -- A grand jury has indicted three of five New York City police officers involved in the shooting death of a groom hours before his wedding, one officer's attorney and their union president said Friday.

A person with knowledge of the case said the other two officers were not charged, according to The Associated Press.

An official announcement of the grand jury's decisions will be made at 11 a.m. Monday, the Queens district attorney's office said.

But attorney Steven Worth said Michael Oliver, Gescard Isnora and Marc Cooper were indicted by the grand jury. Worth represents Michael Carey, who he said was not indicted. Paul Headley is the fifth officer.

Earlier, attorney Paul Martin had told CNN that his client, Cooper, had been indicted.

"I'm disappointed. ... I'm shocked," Martin said.

Neither attorney was able to say what the exact charges are.

The president of the officers' labor union disagreed with the grand jury's decision.

"I do not think that the actions of the officers rise to the level of criminality," said Michael Palladino, president of the Detectives' Endowment Association.

In the early morning of November 25, hours before his wedding, Sean Bell, 23, and friends Joseph Guzman, 31, and Trent Benefield, 23, were at Bell's bachelor party at Club Kalua, a strip club. The five officers were at the club, undercover, investigating complaints of prostitution.

Guzman, Benefield and other members of the bachelor party say they were on their way home after the party when the officers began firing unprovoked.

The officers' lawyers and the New York Police Department say that Bell and his friends were retrieving a gun from a parked car after arguing with another patron, and that Bell's car struck one of the officers and an unmarked police minivan before police opened fire.

The officers fired 50 rounds: Headley fired one, Carey three, Cooper four, Isnora 11, and Oliver 31, which means he stopped to reload before continuing to fire.

The men who were shot were not armed.

The incident brought cries of police racism. Bell was black, as are his two wounded friends. Three of the officers are black; the other two are white. All five officers were placed on administrative leave.

The Rev. Al Sharpton, who has been acting as a spokesman for the families of the shooting victims, called the indictments an important step against police violence, according to AP.

"The only way you make sure it doesn't happen again is you stop it, and you punish it and you send a signal that we live in a society where laws have to be respected," he said, according to AP. "So there is no joy, no vengeance, no party here."

Palladino said the officers had acted in good faith based on a perceived threat to public safety.

"The message that's being sent now is that even though you're acting in good faith and pursuant to your lawful duties, there is no margin for error."

Last-minute witness
Palladino told CNN that he heard from several sources that a last-minute witness testified in front of the grand jury Thursday.

The witness, a 55-year-old man, works overnight near the strip club. Palladino said the man walked into a Queens precinct station Wednesday and told detectives he was an eyewitness to the shooting.

Palladino said the witness told detectives that there was a fourth man in addition to Bell and his two friends, and that the fourth man fired one or two shots at the police officers. He also said he saw police officers shooting at the car in which Bell and his friends were sitting, according to Palladino.

On Friday, an attorney for Bell's parents said the credibility of the witness was at issue.

"There is a word for an individual who tells two different stories on two different occasions about the same event. I believe that word is a liar," Peter St. George Davis said.

On Thursday, Sharpton called on Gov. Eliot Spitzer and Attorney General Andrew Cuomo to appoint a special prosecutor to investigate the new witness' credibility.

Sharpton told reporters that the witness' behavior is "suspect" because when the man was first interviewed by the Queens district attorney, he did not say he saw the shooting.

The fact that he came forward with that information to the NYPD instead of the district attorney's office, with whom he had already spoken, "smells of high heaven," Sharpton said.

District attorney spokesman Kevin Ryan said his office does not comment on grand jury proceedings.

Ok. This is bugging the crap out of me. Bloomberg keeps saying things that make the officers look like they did actually shoot this guy without a reason. I think he needs to watch his mouth. He could be setting the public opinion of these officers into the negative.

Isn't this a little weird though. The witness claims to have seen a 4th man bust a few shots off at officers but no casings were recovered from him? The close proximity of the indictments could have motivated this man too.

I've been following this from NJ. I'm fairly sure the officers had reason to shoot, and this should come out at trial.

While I don't know all the facts, I suspect that Bell and his buddy were up to no good, but they probably weren't the target of the UC operation.

A late witness also testified that there was someone who shot at officers several times before leaving the scene. This just came out too.

There was defiantly a 4th person present who was armed ... I can see no other reason that the officers would have reacted in that manner if their lives were not in danger.

My feeling is that this 4th person also took the gun that Bell had and then Person #4 fled the scene before backup officers were able to secure it. So hence them not finding the gun that Bell or Guzman claimed he "was going to get"

If you live in NYC like myself, you will remember good Al Sharpton taking up the Tawana Brawley case. . .

This case is no different. . .I hope this guy can keep his mouth shut and let the facts come out first. If the LEOs that fired those shots are guilty let the facts dictate that in court. The outcome will interesting.

Sharpton's mouth has been flapping the moment this story hit the front pages. Not only that, but some of the dumbest rallies I have ever seen were held in NY protesting the shooting; complete with high profile speakers making the most bold assertions they could.

Anyway, the truth will come out in trial.

I think a large question for the officers will be trying to determine why only 3 of 5 were indicted. Forget about the 4th man. Why did the GJ decide 3 shots was reasonable but 4 or more were not? Were the officers justified in shooting 3 times? Answers to these questions may help in their defense. Never, ever testify before a Grand Jury if you are a target.

I was sickened when I saw Sharpton on Geraldo last night. They kept referring to Shawn Bell and his friends as innocent victims. The officers as criminals. Sharpton brought into question that he believed Officer Oliver (I think that's the name) was actually intoxicated on the night of the shooting. What a disgrace! I can only hope these officers will get a fair trial but it's not looking so good. My best to those officers and their families.

NEW YORK (AP) — Three police officers charged in a 50-bullet barrage that killed an unarmed groom on his wedding day went before a judge and had their first encounter since the shooting with victims and their families.

In a packed, tension-filled courtroom yesterday, the three officers showed little emotion during the 20-minute hearing where they pleaded not guilty in the shooting that killed 23-year-old Sean Bell and wounded two of his friends.

The officers fired 46 of the 50 shots. The judge set bail for the two officers who fired the most bullets and released the other without bail.

Survivors Joseph Guzman, in a wheelchair, and Trent Benefield, using a crutch, attended with Nicole Paultre Bell, who was engaged to Bell and legally took his name after he died.

Queens District Attorney Richard Brown unsealed the indictment yesterday charging detectives Michael Oliver, who fired 31 times, and Gescard Isnora, an undercover officer who fired 11 times, with firstdegree and second-degree manslaughter.

Oliver also was charged with endangerment for a bullet that smashed through the window of an occupied house. A third officer, detective Marc Cooper, was charged with a misdemeanor for a bullet that struck a train station across the street.

Sean Bell was killed after his bachelor party at a strip club. Attorneys for the officers have said their clients were convinced that Bell and his friends were going to retrieve a gun from his car to settle a dispute

I'm no Sharpton fan. But it does seem to me that these people are NOT in trouble "just because they are cops." They're in trouble because somebody got dead, and if they were not cops they probably would have been in custody this whole time.
That said, the system will now take whatever course it takes. I wish NY had televised trials, this is one I'd watch.
My heart goes out to everyone involved.

So Fla Cop you misunderstand my post. My saying anyway is another way of saying "in any event." They have been indicted the next stage is up ahead no matter what. From what I understand of this incident, I side with the officers.

I agree with Fair Witness though. A man died that night in a violent barrage of gunfire.

Hell no. If he was killed he would be martyr'd. If he dies of old age he will be a headline that day and gone in a week.
