I have a ballistic vest sitting in my closet from my last job. It's a Galls Level IIIA vest which perhaps some agencies may use and I was thinking of putting it on ebay for sale. My question would be is this legal? And if so, would I be responsible for it even though I put up a disclaimer stating that I am not?

According to Federal and some state's laws, it is unlawfull to be in possession of body armor while commiting a crime or if you've been convicted of a violent (re:gun) crime.
If you sell it a loss prevention specialist, security guard, or someone in a similar circumstance, you should be fine. I don't know how you could do that properly in a public forum though. Also; if it's over 5 years old it may still stop bullets, but the manufacturer won't warranty it.
There was once a site where you could donate used vests and they'd send them to our LEO brothers on other countries where they may not be available or affordable.

Honestly I wouldn't want to sell it to a LEO or anyone in law enforcement for that matter. Worse case I would give it to someone who's into paintball or maybe a security company (which I wore this for). I don't even want to risk anything getting into any trouble. Worse case I'd leave it in the closet or find a way to dispose it. It's only a year or so old.

A good rule of thumb to take reasonable care in selling an item like this is to ask the buyer to provide you with a copy of their conseled weapons permit, and tell them that you will ship to the address provided on the carry permit. (If the state they are in does not issue permits but does not prohibit body armor, see next)
If you are selling localy, ask the person to provide you with a copy of a record check done by the town PD within a week prior to the transaction.
Is anything forsure?
NO.
Is it a way to show you have taken reasonable care in the sale of this item to make sure that whoever got it was not a prohibited person?
Yes.
