A car is sitting at a stop sign at an intersection, waiting for it to be clear so he can make a left turn. The cross-traffic does not have any traffic controls.

Another car comes to a stop sign on the opposite side of the intersection, facing the first driver, waiting to be able to go straight across the street.

Who has the right-of-way?... The guy turning left who has been there the longest? or the guy going straight, even though he just got to the intersection?

I think that the guy who has been waiting at the exit from the parking lot, he is 85 years old and cant see far enough so he is sitting there making everyone ELSE get confused.

If it is a 4-way stop sign, then I assume whoever got their first should go. However, just because you're there first doesn't necessarily mean you have the right-of-way. It's courtesy more than anything. Best bet is to come to a complete stop, and continue to take the left turn. If the person directly across from you proceeds after getting there 2nd and t-bones you in the passenger side of the car, I would cite him for failure to yield.

at a 4 way stop intersection, the first vehicle at the intersection has the right of way. If two or more vehicle's approach at the same time, the one on the right has the right of way.

(c) When two vehicles enter an intersection from different highways at the same time and the intersection is controlled from all directions by stop signs, the driver of the vehicle on the left shall yield the right-of-way to the vehicle on his or her immediate right.

I just edited my original question to make it more clear - the cross street is a larger street and does NOT have any stop signs or lights.

I run into this situation frequently, and am really curious as to who has the right-of-way. ... The one who's been there longer or the one who's going straight?

If someone can clarify, I'd appreciate the info.

This is California law, not Texas.

21800. (a) The driver of a vehicle approaching an intersection shall yield the right-of-way to any vehicle which has entered the intersection from a different highway.

(b) (1) When two vehicles enter an intersection from different highways at the same time, the driver of the vehicle on the left shall yield the right-of-way to the vehicle on his or her immediate right, except that the driver of any vehicle on a terminating highway shall yield the right-of-way to any vehicle on the intersecting continuing highway.
