You would be advised that you have an order of Protection against you by a Deputy Sheriff, he will give you papperwork advising the places you are not to go, and who you are not to make contact with. Once in place the only way you may make contact with the person is with an attorney acting as you intermediary. The initial issue will be what is called an ex-parte (here) or a temporary order of protection. Ther e will be a Vourt date which you may attend, in which the victim (person asking for the order) makes their case as to why the Respondent (the person to be kept away) is a threat to the victim. If a Judge believes the reason is valid they will issue a Full order of protection, that will last a year, and there will be a new hearing. If the respondent does not attend the hearing it will usually be granted. However I have attended hearings, that the respondent convinced the Judge that they posed no threat, and the Order was cancelled.

A trespass warning may be given verbally, but it is preferred that it be given in writing. Any person having control of a property (or their agent) may issue this to another person. The net effect is to move the act of trespassing up to a Class A Misdemeanor, and it is arrestable upon sight, no investigation is required.

If you have not been issued an order of protection, and one is out there to be served you contact your local sheriff's Office.

:confused: How do you go about finding out wether or not someone has put a supposed restraining order against you - or a no tresspassing warrant on you when all you were trying to do was help?


If you were trying to help why would there be a need for it :confused:

It doesnt matter if they have one are not, if you are looking to stay out of trouble just stay away from anyone who may have a order of protection against you in the first place.

What kinda help or assistance were you or did you provide that now the other party wants a restraining order or OP against you? You ain't being completely stra8 brother.... :confused:
