View Full Version : writing a speeding citation

when writing a citation for speeding, is it necessary to include a mph? I ask because i just got stopped for careless op and speeding, but the citation just said speeding, with no speed. i asked the officer and he merely said i was "exceeding the speed limit" but with no numbers to back it up. I'm questioning that part, on the careless op when turning at a light the back of my car did slide a little, nothing major and it wasnt intentional, i drive a decently modified Mustang GT, those things randomly happen.

i identified myself as a reserve trainee, told him i had a weapon in the car and very slowly removed and secured it for him, i was very respectful and still got written up... I'd have given him a break! :(

anyway, how does a speeding citation hold up without numbers backing it up? I thought that was a required part, and we havent been instructed in traffic laws yet, so i had to ask the experts here. hopefully i can try and get it taken care of.

Don't know La. laws, so can't say if the charge will hold up based on what you wrote.
I do know that Mustang GTs come with nice rubber, it takes some HP to just randomly break it loose when accelerating in a corner, I suspect that rather than "accidently" or "randomly" doing so, it did what it probably does half the time as the young toad driver gasses it every chance he gets. Don't take offense, I once was a toad myself, did the hot car deal back in the '70s with TriPower GTO, RoadRunner, Dart 340 Swinger, and Chevelle SS 396 with transplanted 454 with TriPower on top (from a '67 Vette). I can still recognize a toad to this day, my "budds" say there is still one in me. I don't know, maybe they are right, only retirement will tell. :D

That's nice, but not everyone is wired like you. Being a LEO is not an excuse, it should become a way of life and how you conduct yourself off duty is just as important as when you are working. You still set the example. :)

Again, depends on the statute he wrote it under .... sorry I can't help more. :confused:

(PS ... Put a little more effort in your writing. Hit that "Shift" key once in a while when needed to capitalize when it's called for. I am not a stickler on spelling, but your writing leaves a lot to be desired before you start writing reports.)

What's done to the Mustang by the way? I'm assuming it's a 99-04 GT

the stock 245/45 goodyears arent much on grip, I stepped up to 275/40's but it still spins. If I had intentionally meant to do something like that, it would have been alot more pronounced. I was suprised that it did that, it wasnt much, just a lil twitch of the rear end. The steep gears can sometimes make it a handful. I'm not making excuses for that, I know it wasnt what a normal person would consider "safe", but it happens to me alot (both intentional and otherwise, I'll admit to that). If I was a completely irresponsible person I wouldnt have been at that light, i would have ran it under yellow and been alot more reckless about it, but I decided to play it safe and it still came back to bite me.

I know I have to set the example, and I try everyday to do so. As far as 21/22 year old college males go I think I do allright.

He wrote it under L.R.S 32:61,

Based on what YOU wrote: The law section does not seem to apply. Reason would tell someone that you were not doing over 55 around a corner from a stop. Here in Ca. and I would assume in LA there is a exhibition of speed law, that can be cited for "burning out", breaking traction, etc.

It may be that in LA the courts just recognize that under the max speed section. IF however, it is as you state and no other "missing" info, then it will probably be dropped. Who knows, maybe he wrote it that way to give you the break along with the headache.

Knowing you want to be an officer why would you drive like an IDIOT anyway ?
In Ohio ticket has blank for speed and for speed limit. Take it that officer knew what he was doing and pay tickets and hope that driving like an IDIOT does not put your career chances in the toilet.

We had a cadet in a class here that was cited for reckless op and speed and was removed from the class.

That's funny, I've been driving for a long time and I have never had my car fish-tail "randomly."
