Fire chief avoids charges from abuse allegations

Published: Thursday, June 23, 2005 12:36 AM PDT

San Francisco Fire Chief Joanne Hayes-White will not face domestic abuse charges based on allegations by her husband, which were later recanted, due to lack of evidence, the District Attorney's Office said Wednesday.

Police domestic violence inspectors launched an investigation Sunday night after Hayes-White's husband of 12 years, Sean White, called 911 saying his wife had hit him with a pint glass at their home.

Police have not revealed details of their investigation, but said they found no visible injuries and White declined medical treatment. He recanted his allegations to police Monday.

Law enforcement sources have said Hayes-White, 41, told investigators her husband hit himself over the head before calling 911.

A spokeswoman for District Attorney Kamala Harris said Wednesday that the decision not to file charges was made after a team of domestic violence prosecutors and Harris examined the case and concluded there was no corroborating evidence of an assault.

Hayes-White, who became the first woman in the nation to head a major city's fire department, referred calls to her attorney, Jim Collins, on Wednesday. Collins said he was happy police and the DA "did the right thing."

Mayor Gavin Newsom, who appointed the chief to the $203,000-a-year-post, expressed strong support for her Monday, characterizing the incident as a private family matter.

The Police Department's policy on domestic violence allegations directs officers to arrest a suspect if "elements of a crime" are found at the scene. Police have said they conducted a standard investigation. Full details of what police observed at the scene, and what Hayes-White and White said to investigators, is not yet known.

So... could I move to SF, get a girlfriend, slap her around, and have the whole thing dismissed as a "private family matter"?
