If I have a loaded and chambered 9mm in my glove box, I am 22 years of age, am I committing an illegal act if I notify the officer if he asks?

Keep in mind: Not a felon, legally purchased the firearm, CCW is in the mail waiting to be sent and I was, let's say, pulled over for speeding.

I would guess it depends on what state you are doing this. In some states it's illegal, and I think that there are some states it's okay.

If your state requires you to have a ccw permit, and you do not have it (because it is in the mail), then my guess is that the gun is illegal. Why take the chance if you will have the permit soon.

In WI, and maybe other states, yes its illegal. It is in violation of the CCW statute. As said before, if the permit is in the mail, just fricken wait, why take the chance???

damn, been awhile since I checked the statue of firearms transport for GA. But I know in the trunk unloaded, or openly displayed on pass. seat or back seat is ok. 99% sure weapon has to be unloaded though. Glove box would be concealed weapon. Call your local sherriff or PD to confirm that.

As long as it's in plain view, or in the glove box or other similar compartment you do not need a permit. However, if it is hidden, you must have a CCW.

section 16-11-129 of GA revised code reads that the gun must be licensed to carry it in the vehicle loaded. If the gun is licensed it says you can carry the gun anywhere within the vehicle.

If you were traveling in my state, Montana, and with the information you provided, no you would not be breaking any laws. Each state is different, even cities and counties can differ within a state. Check your local laws.

how is it in the glove box.. out of curiousity... is it in a holster or all by itself where anything can get stuck in the trigger guard?

in Maryland its illegal to have a concealed hand gun. It has to be on the front seat, empty, not clip, bullets, anything. they are very serious. Although you can have shotguns anywhere in the vehicle, unloaded of course. but they both have to be in there for transport to and from a designated shooting area

I had a Police Officer come on my Post to talk to me since he did not know we had security at this place. He ran my plate when he pulled up to my Own car im un marked patrol. It came back valid Ohio CCW. He asked if I was carrying I said no because this is a un armed assignment and by agency rules i cant carry etc. He said that sucks. Ohio has some provisions that need to be taken out of the CCW Law. One provision says a CCW holder must while inside the car have his her weapon plain sight. That would me open carry. But when she gets out of the car that would be Concealed. They also have dumb provisions about people kepping the gun in the glove box etc. Well many Ohio Police Officers have had guns stolen from his/her personal cars. So keeping a gun in the car is not a good idea at least to me. In Ohio everyone unless You are LEO or Military trainined within past 5 yrs has to complete 12 hrs training then apply for the permit. After its ready You go pick it up from the sheriffs dept. In Ohio since the CCW law has been started Ohio Violent Crime has droped. According to the FBI and others States with CCW have lower crime than states with out it. (I.e) NYC and other big cities that have more crime than any other in the country.

In many states, if you have a CCW permit, you are required to tell the officer you are armed, or if the weapon is in the car. Failure to do so is a trip to the pokey, your weapon is confiscated, and you lose your permit, never to get another again.

I know. In Ohio You have to tell them if You are carrying You tell that u have a ccw and are carrying and listen to any instructions they have. I belive in IN and KY they dont have a provision. I will do what ever the state law says. Indiana and KY dont have some of the provisions that Ohio has in its CCW Law. I wish Ohio would do some of what Indiana etc has done.

One thing i wanted to ask is your opinion on this. In Cincinnati Tri State a Police Officer was in the court house and i elive he went to use the rest room and by accident left his weapon in the rest room. When he went back it was gone. And the Police searched all over and coult not find the weapon. He was given a reprimand for it. Was not dismissed from duty or anything. I just wonder if he will have to go do some re quail training. But my thing is this. Im a Ohio CCW holder and if that was me i would probably maybe be charged and arrested and my ccw would be revolvked. But i have a problem with something. How come when a police officer does this he does not lose his/her firearm certification ? How come if a CCW and i say if a ccw holder did such a thing why could they not make them attend some re qual training course of some sort.

In Alabama, you must have a valid CCW permit IN YOUR POSESSION if you have a handgun in your vehicle or on your person. It doesnt matter if it's loaded or not. You are allowed to have a handgun without a CCW if it is not accessible by the occupants of the vehicle (locked in trunk). Incredibly, you can have a loaded rifle or shotgun in your vehicle or on your person without any type of permit. In all cases, you better disclose this to the officer if you're asked, otherwise you're in deep doodoo if the weapon is found.

Illinois does not have concealed carry. What you are describing would get you a trip to the pokey and you can kiss the gun goodby. Each state is different. Do not travel with a firearm without checking the various state laws, unless you fall under the new federal law, which you obviously don't.

It's relatively easy to get a CCW in Alabama. You simply have to have a clean background (no felonies or domestic violence) and be on the "good" side of the local Sheriff. After filling out a simple form, pay the $25 and get your pix taken, the photo i.d. permit will be mailed to you within a few days if everything checks out.

Of course in Alabama, it is law that all children are given a firearm and taught how to use it on their first birthday :D

No. However if the officer doesn't ask and you fail to tell him, don't be surprised if you end up face down on the blacktop with a pistol in the back of your head.

Us cops like to know where guns are at all times. Even as a cop, if I get stopped while off-duty the first words out of my mouth are "There's a gun in the car."

Now, if you would have taken the time to read the other thread titled Where to carry?, you would have seen where I posted GA law.

a) Except as provided in Code Section 16-11-127.1, a person is guilty of a misdemeanor when he or she carries to or while at a public gathering any explosive compound, firearm, or knife designed for the purpose of offense and defense.
(b) For the purpose of this Code section, 'public gathering' shall include, but shall not be limited to, athletic or sporting events, churches or church functions, political rallies or functions, publicly owned or operated buildings, or establishments at which alcoholic beverages are sold for consumption on the premises. Nothing in this Code section shall otherwise prohibit the carrying of a firearm in any other public place by a person licensed or permitted to carry such firearm by this part.
(c) This Code section shall not apply to competitors participating in organized sport shooting events. Law enforcement officers, peace officers retired from state or federal law enforcement agencies, judges, magistrates, solicitors-general, and district attorneys may carry pistols in publicly owned or operated buildings.
(d) It is an affirmative defense to a violation of this Code section if a person notifies a law enforcement officer or other person employed to provide security for a public gathering of the presence of such item as soon as possible after learning of its presence and surrenders or secures such item as directed by the law enforcement officer or other person employed to provide security for a public gathering.

Wouldn't it be nice if we had some uniformity in all these ignorant gun control laws? Some laws change by county. We recently got rid of this in AK where towns and villages had gun laws more un-friendly than state law. Makes it difficult to be a law abiding citizen. Perhaps with the cwp they could issue a GPS guided I-POD that warns you of changing laws while underway....warning, warning Will Robinson....You are entering a gun unfriendly enviroment. Just plain silly. I believe a national policy to the effect that if you are allowed to own a firearm, you should be able to responsibly carry anyway you please. If you cant follow some basic rules that would be in place, you cannot carry...period. Am I over simplifying the subject from my small town Alaska view? I spent my first 28 years of life in Miami and swear if every law abiding citizen carried, It would be a much better place. I personally feel very safe when I see citizens with handguns in open carry in stores. If I were a BG I would look elsewhere. I have swayed my wife to start carrying her lil .357 ladysmith in her purse due to the latest Pharmacy robberies looking for Oxycontin. They dont expect the Pharmacists to be armed. I expect her to give and give to the robbers. When giving is not enough and they decide on a deadlier course, I want her to have an option. Why is this not a national policy? We bow to the BGs. Are we sheep?(

If this character did say that they are entirely false and making it up. I've got a degree in biology and chemistry and I'm planning to start medical school next year, noone offers a MD in Ballistics, it's a MEDICAL degree, not a forensics degree! A pathology degree might be close, but lots of pathologists are opting to get a DO instead of an MD.

i would say that it is a bad idea without your ccw, if an officer sees, it your going to get taken out of the car high risk style probably before you can produce the permit anyway

A so-called friend of mine was arrested some years ago for CCW; he had an unloaded revolver locked in the glove box of his car. The car was locked, and his girl friend was 50 feet away, with the keys in her possession.

I went with him to the investigator from the county attorney's office, and explained to him how that really was not CCW under the laws of this state, and how the PD didn't even have probable cause to search for a gun in the first place(they found the revolver cartridges in his pocket). Charges were dropped, the gun was returned, and why that "friend" didn't sue the pants off the officer(more that just what I explained) I'll never know, but I did tell that cop to his face had that been me instead of that other guy, he would not only not have that badge anymore, he wouldn't have a shirt to pin it to!

Where "carrying a concealed weapon" is defined, it's where a weapon is carried on your person out of sight, or is nearby out of sight, where it can be deployed immediately. Loaded, in an unlocked glove compartment may be iffy, but why chance it? Leave it in your trunk(unloaded), or just leave it home until you get your CCW. In many states, carrying a weapon openly without a permit is a no-no also.

Don't know about other states per se, but in this one, one exception to a CCW is if you carry the weapon "in a closed and fastened package too large to be concealed upon the person." I asked the county sheriff if that meant a tool box locked with a padlock; he said that was perfect! That's how I was carrying my weapon that day I used it to shoot this cur of a dog that was going to attack my brother. Deputy Sheriff who came to investigate the situation said I was legal in how I was carrying that gun, and in how I brought it into play(I wanted so badly to shoot the dog's owner, too, but knew better than to).

Keep something else in mind; having a CCW does not entitle one to bring it into play any time they think it is justified, nor be careless with it in how you carry it, or where you keep it.

Like the other said, study the law, and know the law in your state.

Oh, and I am one of those police officers who could care less about whether or not there was a gun in the car. So... good for him. Makes me realize I'm dealing with a smart individual instead of a sheep.

If a hook has a gun, who cares. If he decides to use it unlawfully, I'll dissuade him as the law allows.

Move on, there's nothing to see here...
