Hi all...
I'm new to the boards. My husbands resent injury led me to this website.
He was injured on the job taking down an 18 year old drunk, and will be out of work for the next 4-5 months. He's going to need shoulder surgery. (good thing we get along....lol)
I'm just wondering if how any of you handled an on the job injury, what I mean is would you sue the person for pain and suffering or did you?

If they have any money, most don't. Bear in mind that what ever medical damages you recover will go to the dept. if they paid for his treatment.

I"d never totally discard the idea of a lawsuit,but keep in mind that winning is one thing,collecting could be another thing altogether.Might not hurt to consult with an attorney.

If your husband works a lot of PT off-duty work and can document how much he works on a monthly basis, not to mention regular department overtime, he may be able to sue for lost wages.
If this is cash PT then he is out of luck.
The dept will cover him on his salary but these other monies are gone.

I know my parents neighbor who was a copper sued the drunk who smashed into his squad ending his le career.

Here he could claim under the Criminal Injuries Compenstaion Scheme and thats money paid as compensation by the Govt. Getting it off the scrote is a different matter, I got
