After watching some Network and MTV specials on illegal street racing, it got me wondering what different jurisdictions do, if anything, to stop this. I just spent the last hour or so looking at the Virginia State Code and using a little bit of imagination, I was trying to put together a list of charges a creative prosecutor could bring against racers and those who aid in racing, as well as the auto shops that provide the means to do the activity. I've been reading the text of the law, and depending on how you interpet it, I found that depending on the circumstances of the crime, in Virginia, those who take part in street racing could be charged with:
1. Racing (No explaination needed)
2. Reckless Driving (ditto)
3. Aiding & Abetting Racing (Same as #1, only for those who don't do the driving)
4. Disorderly Conduct (Racing in public streets is very disorderly)
5. Conducting an Illegal Gambling Operation (People bet tens of thousands of dollars on the outcome of this criminal activity, and they do it with out regulation from the state, so it is illegal gambling)
6. Use of a Police Radio/Scanner in the commission of a crime (Often these racing groups will have a scanner handy to watch out for police)
7. Criminal Solicitation (Encouraging others to participate in one or more of the above crimes)
Now, This is if you apply the law in its broadest terms. I didn't even include the crimes you might add if something goes wrong during a race and people are injured/killed. Then you are looking at the big crimes (For example, depending on the circumstances, a good prosecutor might be able to indict on Murder in the Second Degree, if someone dies as a result of street racing).
So what do you guys do to stop street racing?
