hm i have a lot of questions...
1) i know you have to be detained to be searched which requires specific and articulable facts... so does that mean a school can not search me just cause a narc called in and told them i had drugs?
2) are gopeds legal for street riding in florida?
3) what would a minor's sentence be if he commited credit card fraud?
4) are fresh psilocybin mushrooms, not dried or anything, just growing in the ground on your property illegal?
5) what ways can you be able to digest cannibus legally... like if you have glaucoma or whatever...
6) i was riding my bike in my neighborhood late night and a cop stopped me and told me he'd have to search me, so i said "are you detaining me? am i free to go?" and he said "do you want to be arrested?" and i said "no" then he said "then let me search you" so he searched me... one reason i hate cops...
say NO to hard drugs!

Just when I was ready to take him seriously, I saw his last comment. Quite bold to say to say the least. OK, I'm gonna give you some of the answers you're wanting, Bum, but don't get your panties in a bunch when you find out that they're not the answers you want to hear.

School grounds are a different animal.

Depends on age of the rider and brake horsepower.

I'm not really sure because of the differences in juvenile and adult laws. It all depends on the judge. Would you like to expound on this one?
4) are fresh psilocybin mushrooms, not dried or anything, just growing in the ground on your property illegal?
No, but why would you want a fungus in your yard?

That's a hot topic, but the simple question would be not. If you feel like you need canibis to make your ills go away, then see a doctor for guidance.

We can ask for consent to search and we can pat down your outer garments for weapons.

2. Did you have a light on your bike?
3. How old are you? Under 16? Did you have a helmet on?
4. Was it a school night?
5. What were the officer's exact words? Not the words you think he said.
6. Why do you hate cops so much? Because you feel like you can just ride around anytime you want to, doing anything you want to?

heres the dailogue from the best i can remember, no exagerations...
me: hi
cop: hello son, why are you out here tonight?
me: just riding around, going to a friends house maybe
cop: well im going to have to search you
me: what, why? are you detaining me? can i leave?
cop: do you want to be arrested?
me: no
cop: then let me search you
me: but are you-
cop: son let me see your pockets
and then he searched me, didnt find anything, and he let me go... i think he was bored and felt like messing around with a kid

1. 11 on a weekend...not that bad, but it's also around the time cars start geting broken into, mailboxes smashed, etc.
2. In the state of Florida, all bicycles are required to have a forward facing white light and a rear facing red light. Reflectors don't cut it.
3. So, just because the police there don't feel like enforcing it, it means that you're exemp? Why wait to be told to do something. It's your head...if it doesn't mean anything to you, why should it mean anything to the police?
4. OK, covered that one.
5. Kid on a bike around 11:00, with no light and no helmet, stating he was going "to a friend's house"...this is the standard scenario all over. This is the story we get all the time.

Probably far from it. If juvenile crime is as rampant where you live as it is where I live, there's a good reason for it.

A few more answers to expand on lawdogs:
1) School officials can search you basicly anytime they feel like. They really don't need a reason.
2) Define goped.
3) Couldn't tell you. I can tell you what his sentence is if he doesn't commit a crime.
4) I see this one a little different. If they are growing wild, they are technically contraband and can be destroyed. If they are being "tended", you can be charged with cultivation.
5) By your post, I'm guessing you're in FL, so the answer would be you can't. FL has no medical exception.
6) I read your recount of the dialogue. I saw 2 citable violations. IF the conversation went as you say, he may have overstepped his bounds a little, however, your evasive answering (going to a friends house maybe)was starting to head toward a loitering and prowling charge. I'm guessing the search was to dispell his fear that a crime was being committed or about to be committed, which is the major element in a L&P charge.

oh and about searching at school, my friend got searched once, and he said "do i have a choice if you can search me" and they said "we can only search your backpack" ... were they lying?

Since the school administrators are there to educate, not be cops, they don't spend a load of time reading legal decisions. They usually only know what their legal counsel told them during in-service traing 2 years ago.
You asked a question. We gave you answers. Now you want to start with an attitude and do the "who's lying" bit? You totally ignore my request to define goped so you can get a better answer.

i didnt say that i was going to vandalize anything, i didnt do anything illegal... and i really was just riding my bike around... my parents and i had an argument and i felt like getting away from my house, so i rode around my neighborhood for a while thinking...

what attitude? and i was asking you or anyone else if they were really aloud to search my friends backpack or not... and sorry, i guess i read over that... but i meant a goped as www.goped.com (http://www.goped.com) like the skateboard thing with handlebars and an engine that goes around 15-20 mph

Don't you think maybe you're being a little hasty here?
The persons who answered your questions are volunteers, and spent time that they don't ever get to spend again, just to answer your questions.
If the answers or response questions were harsh, in your view, you might think about the fact that they are only over the internet, and if you read them and think about what they mean, they might save you from another unpleasant encounter with the police in your area.
It's true that some officers use pressure to squeeze search permission out of someone. The normal reason for wanting to search is suspicion; not boredom.
As for your questions, they make you seem like someone who is trying to find out more accurately what the limits are on what you can get away with, so that you can act on the borderline and know when you might be stepping over it. Maybe that's part of why you got answers you didn't like.
Have a nice day, and I suggest you say no to psilocybin, even if you think it might be fun.
Even if you're certain about what you're getting, which is doubtful, as AussieCop pointed out, it could change your brain.
You have a lot of years ahead of you to live with that brain, provided you're careful enough in dangerous situations, for example when you're driving 20 mph at night on a lightless go-ped without wearing a helmet. Maybe that's a situation that you would do better to avoid in the first place.

Nor did I say you did. But look at what I was referring to. Where you talk about how you wouldn't be out vadalizing anything alone because it's not fun alone. That sounds like experience talking. Whether it is or not, it sounds that way and detracts from your credibility.

monty... im not saying i didnt like the answers... im fine with those answers, its not your guys choice what the laws are... thats true that he was probably suspicious, i would probably be to...also, i didnt say anything about wanting to try psilocybin... my friend is growing them and i wanted to see if he could get arrested for them... which nite told me about... i dont have a goped... i might be getting one, and i would always ride with a helmet... ive already had one bad accident... but i just usually dont put a helmet on when i go riding my bike 2 miles an hour...
niteshaft....i dont need the statute numbers... ive never heard of a law pertaining to riding a bike without a light on it... when does the police consider it "dark"...or what time do they enforce this law? i wasnt being a wise guy... i said it in a way i would say it to my dad or mom, with respect... i thought you meant an attitude to the cop... my bad...listen i dont want to fight with you guys... just discuss my questions

After you explained the scooter thing, I have to say no, they're not authorized for street use. There may be some kind of city/county ordinance against it, though
When do the police say it's dark? Not sounding like a smart aleck, but...when it's dark. A good rule of thumb, and one mine and my friends' parents used to use...if the street lamps are on, it's dark.

I would have expected something more like, "If I use my parents credit card to by something on the internet is that illegal?, and what will happen?". But you asked what the sentence would be if caught. To me it sounds as if you are weighing the pros and cons, and frankly, I'm surprised none of the oficers had more questions about that question.
I don't know about anywhere else, but here in Texas, for headlight use on autos, dark is "From thirty minutes after sunset, to thirty minutes before sunrise, depending on weather conditions". If it is cloudy it will get dark sooner.

well nikon... i asked that question because my friend, im not going to name names, but he purchases items on the internet with stolen credit cards... like the group hes in hacked a banks site, which had all their credit card info for all their customers, which they stole... and i wanted to know what would happen to him if he was caught? hes a minor...

Then maybe you do need the statute numbers. Actually, I saw a third violation when I thought about it.
316.2065(8)- requires a white light on the front visible at 500 feet.(violation #1)
same statute also requires a lamp exhibiting a red light visible at 600 feet, plus a reflector, on the rear (violation #2)
Violation #3 was the helmet.

I think some others have already answered you on this. FL statute defines daytime in the paragraph that talks about the requirement for your bike. It says between sunset and sunrise.
Further, FL law also requires them on any vehicle when smoke, fog, rain etc. reduce visibility to a degree whereby persons or vehicles are not clearly discernible at 1,000 feet.
