View Full Version : AGE Requirement and Federal LE positions

This weekend I was reviewing open LE positions on USAJOBS.gov and started seeing different wording on the position announcements that have an age cutoff.
In the past, it was generally written as;
Federal Law Enforcement Officer (FLEO):
This position is covered by the special retirement provisions for
Federal Law Enforcement Officer (FLEO). Candidates without previous
FLEO service must be under age 37.
Now, I am seeing;
Be between the ages of 21 and less than 37 at the time of
appointment (unless you have previous service in a Federal Civilian
Law Enforcement position covered by special civil service retirement
provisions, including early or mandatory retirement or are a veteran.)
Can anyone provide any insight on this matter? Simply stated, I now read these with the veteran statement to allow entry into these positions (where the new verbiage is added) for military veterans after Age 37. Might this be starting something new. How can this work towards retirement, etc.? My first guess is that it may have to do with being able to buy back our military time but that could be way off base.
Thoughts?

THere is a BIG thread on the exceptions for some veterans, there wasa no talk of extending it to ALL veterans but who knows. What position was the posting for?

It tells Federal agencies to apply the federal law as it is written. Some agencies have been slow in adopting the guidance. The federal law in question is:

Nothing in the decision addresses retirement or retirement issues. It would seem that if the veteran was under 40 years old when hired, they would still be eligible for 12(d) retirement. I don't know how the agencies are working it if the veteran is over 39.
I do not believe the federal government will ever allow vets to purchase their military time as 12(d) time. I do think they should allow it to be purchased as 12(d), because military service clearly fits within the definition of "rigorous duty" as defined in the CFR.

KC link is to the original PFR (petition for review). This review confuses most because they get caught up with unique State Department rules and laws.
The following link is from the PFR based on OPM request. This opinion is what really caused the change. Since it sites universal requirements OPM has been using to justify its not following the VEOA of 1998.

As a veteran and being 41 years of age I am applying to all 1811 vacancies that interest me. Since January I have applied to 73 announcements. I have been only disqualified for my age by the IRS and the US Army.
I have filed a complaint against IRS CI and the US Army with the DOL. I am on to the second stage of the legal process with the IRS CI, filing a complaint with the MSPB.:eek:
