I've had a few calls almost exactly like that. Neither time did I shoot becase the guy dropped the gun at the last possible split second. I say you did very well even though you didn't shoot. Situation resolved without shots fires, can't get better than that!

and the old addage remains.....If there is one, there is two, if there is two.......I got a wake-up-call a few months ago stopping a 4 wheeler driving down the road. long story short got tired of his lying and placed him into custody and cuffed him quickly. Upon search we found a loaded 9mm in his rear waiste band. long story stupid; meth head going to buy meth borrows his friends 4 wheeler and was worried they would ripp him off. Woke my *** up!! Be safe out there and remember that WE are our only salvation. just my thoughts.

Glad you were okay. I agree with jswwjw too.

Peanut gallery comment: I feel bad for officers that have to deal with silly issues of jurisdiction.

Many officers at my agency are deputized, so that helps out greatly. Recently we were granted statewide jurisdiction, so that helps even more.

If you have options like this available to your agency, I'd try to get them in play.

im glad you made it out of the situation but remember action will ALWAYS beat reaction....even if the weapon was not pointed at you, if he had decided to shoot he likely would have injured your or your partner before you ended the threat

If you went home at the end of the shift, as did everyone else, then it went well. Sounds as if that situation coulda went either way. I had a similiar expierience, trigger slacked out, gun about to go bang, dude finally drops the shotgun. It took me awhile to get passed it but I eventually did. Oh and I learned a long time go not to sweat what the courts do, or don't do, as it is out of my control. As long as you did your job I wouldn't be concerned about the fines or sentences.

Oh and I can't imagine not being able to hook him up and have to give his weed back, thank god we can take enforcement action anywhere in th state here.

Along the lines of action beating reaction 7 days a week and twice on Sundays...

This is a frustratingly too-common theme in many of the horrible murders and attempted murders of officers caught on dashcams.

I'm not Monday-morning quarterbacking, but let's not let their sacrifices be in vain.

The murder of Deputy Kyle Dinkheller jumps to mind...

It sounds to me that you had/have a wimp for a Chief. City Limits or not, In Alabama you have arrest powers statewide. Put him in the appropriate county jail, keep his weed and guns, and go home safe.

Be proud that you and your partner went home safely.

First, let me say glad it worked out as far as not having to shoot. The rest of the story, let me say WOW!

We cuff the guy up and call in the superviser who calls the Chief. We are then told to let him go because we are not inside the city limits. We uncuff him, give him the marijuana that was in his pocket and leave with only his guns. We are ****ed to say the least.

Alabama must have some messed up laws. You can't make an arrest outside of your city limits? You have to call your Chief when you make an arrest? You have to give a controlled substance back to a suspect if he doesn't agree with your arrest, but you take his legally (I assume) possessed weapons?

Why did you give back the marijuana? Is it legal in Alabama? Sounds like you need a new supervisor, Chief and whatever judge fined him $50.

Whoa!!!!!

If your chief told you to let him go, don't second guess yourself on whether you should've shot him or not. The chief wouldn't back you. Consider this a prelude in the kind of support you would get if you are involved in a high liability situation......NONE.

Would I have shot? I don't know what I would've done. I wasn't there and could only speculate.

Alabama's laws are fine. Weed is weed, there is no way in hell you will get me to give weed back to anyone. We are allowed to go into other counties and make arrests in any part of the state as long as we go through the appropriate judicial system to do so.


What kind of supervisor do you have that would tell you to give weed back to a suspect because he was 100 ft outside of your county? I would make sure you do a detailed report cause i'm sure you can get jacked up for giving weed back to anyone and your supervisor should be taken out back and shot. For instance:

You stop a car, find 200 lbs of weed in the trunk. Well, you find out your PC to stop him isn't really PC at all. The weed gets supressed in court, charges go out the window, but does the suspect get the weed back....HELL NO

For the charges, the judge was within the law.

I remember the first time I realized that someone pointing a gun at a police officer was only guilty of Aggravated Menacing (In OH, a first-degree misdemeanor), how sick to my stomach it made me feel. For a first-degree misdemeanor, I have to make a life-ending decision whether or not to shoot.

Pretty much.

To some of the people who responded, thank you for replying. Just to answer a few of the questions.. Yes I know I have arrest power in the whole state. Yes weed is illegal where I work. Yes it sucked that the decision was made by the higher ups but they give the orders, not me. I took the guns for safe keeping and because they would kill me quicker next time that the weed would.

I did not start the thread and intend the marijuana to be the focal point. By the way, it would have barely been enough for a joint. I know its still illegal but just saying it was not that much. The reason for the thread was to show how close I came to shooting someone because I made the stupid mistake of not doing a pat down. That was it.

Trinic, I will not even respond to you suggesting that this is made up. It's not work the strain on my keyboard. As for where I work, if you really want to know send me a PM.
