What do you do when you have a guy or girl that absolutely does not cooperate with you...Not fighting you, but does not respond to verbal commands....just stands there like their brain is at home?..In this scenario you are by yourself and the violation is public drunkeness

First you call for cover and if you can wait for it. If not, say you're all alone and cover is an hour away but you decide you're going to take this person to jail. First evaluate whether you have a chance of winning the fight should the resistance turn from passive to active. If no then let the drunk stay a free person. If yes then...

1) Give verbal commands

2) Apply hands on the person and attempt to place in handcuffs.

3) If handcuffing sucessful apply pain compliance techniques to gain cooperation in getting the suspect to walk to your car.

4) If resistance becomes active then use the least amount of force needed to overcome the resistance. If you decide to use OC give the OC a minute or two to begin working.

5) Don't forget! A tactical retreat is a fine option if you are losing http://www.officer.com/ubb/smile.gif.

Sorry LeeRoy, I have to strongly disagree here. Evaluate the chance of winning the fight IF he happens to fight? Do you also evaluate your chances of surviving a bank robbery call IF the perps happen to come out shooting before deciding to set up outside the bank? Big difference in type of incident, yes...but same line of thinking. Is the arrest of the drunk warranted? Is he a danger to himself or others? How do you make your conclusion as to your chances of "winning" the fight? How big he is? How mean he looks? I just can't see the reasoning here.

If you make that evaluation ("He MAY fight, I MAY not win because he's big, so I just won't mess with him.") because nobody else will know (Except for YOU and HIM), that is a personal issue. But I wouldn't recommend sharing this reasoning with anyone else...especially rookie officers.

Retreat...wait for backup...whatever you have to do to go home that night, certainly. But there is a line you have to draw somewhere, because you chose to wear a badge. Some things just 'come with the territory.'
