L.A. County Sheriff's Deputy Arrested
IRVINE A Los Angeles County sheriff's deputy was arrested today for allegedly using a sharp instrument to inflict serious injuries on an acquaintance of his wife and attacking his wife, who was not a seriously hurt, police said.

Deputy Robert Avery McClain, 34, a probationary officer assigned to the
Twin Towers jail in downtown Los Angeles, was taken to a hospital for treatment of injuries he suffered.

He was later arrested on suspicion of attempted murder, aggravated assault and domestic violence, Irvine police Lt. Rick Handfield said.

Police were called at 7:15 a.m. to the leasing office at 1000 Peyton,
Handfield said.

The victim, whose name was not released, was found lying on the floor in
the leasing office of the complex where he lives, Handfield said.

He was not able to relay the facts of the assault and was taken to an area hospital in stable condition, Handfield said, declined to elaborate on his
injuries.

While investigating the attack on the man, police learned that the deputy's wife had driven herself to a hospital and told staff she had also been assaulted. She "has less serious injuries," Handfield said. She was not stabbed, but Handfield, citing domestic violence privacy laws, declined to say how she was injured.

McClain and his wife live in another complex, Handfield said.

"There are a lot of privacy issues to deal with," Handfield said.
"The facts of the relationships (between the three) are just starting to
emerge."

The wife remains hospitalized, Handfield said.

McClain joined the sheriff's department less than a year ago and is still on probation, said Steve Whitmore of the Los Angeles County Sheriff's
Department. "He's been relieved of duty with pay," Whitmore said. "If felony charges are filed, he'll be relieved of duty without pay."

Depending on the outcome of an investigation, McClain could face
termination because of his probationary status, McClain said.


This is a very unfortunate situation here.

Not pre-judging, but it appears to be a career down the drain! Too bad. Two people injured - one severely - and for what? A little hanky-panky! That is why they have a law for disolving a marriage.

He is still on probabation (graduated less than a year ago), so he will most likely be fired, no matter what the outcome of the criminal case

According to other articles, he tried to castrate the 23-yr old male that was having an affair with his wife.It takes two to tango.

Adultery is hard to swallow, but he should have just picked up his stuff and divorce her.

In the military, there were 3 simple rules:

Never mess with a man's woman
Never mess with a man's mail
Never mess with a man's beer

Granted, castration is a little harsh, but I doubt the guy didn't know she was married.

At least the deputy has revealed how he confronts stressful situations. This incident should enlighten the department about this deputy, knowing he is still on probation.:)

I pretty much live by those three rules. Apparently, the vict knew she was married. Broke rule #1. As someone else said, Dep was still on probation. He'll be fired soon if not already.

According to the victim's father, the victim told the father that he was in love with a married woman. When the father cautioned him on the issue, he allegedkt resonded that he just could not help himself. Still, he did not deserve the beat down and mutilation he received.

This morning's L.A. Times reports McCain allegedly tried to force his wife to conduct the castration of her lover. McCain also is reported to have resigned from the LASD.

After tricking his wife into introducing him to her lover, a Los Angeles County sheriff's deputy held the couple captive overnight at an Irvine apartment complex where he beat them, forced them to undress at knife point and ordered the woman to castrate her younger suitor, authorities alleged Wednesday.

Deputy Robert A. McClain then allegedly sodomized his wife and chopped off her hair with the knife, Orange County prosecutors said as they announced the filing of mayhem, torture and sexual assault charges against the 34-year-old ex-Marine, who faces a potential life sentence if convicted.


Prosecutors said the nine-hour ordeal began about 10 p.m. Sunday when McClain's wife told him she was leaving him for the younger man, whom she met while working in the leasing office of the apartment complex where he lives.

McClain then used a ruse to persuade his 31-year-old wife to introduce him to the 23-year-old man, said Susan Kang Schroeder, a spokeswoman for Orange County Dist. Atty. Tony Rackauckas.

After arriving at the young man's apartment, the deputy led the victims to a back kitchenette area in the nearby leasing office, where he started to argue with them and attack them, authorities said.


"McClain is accused of taking out a knife and forcing both victims to undress," according to the district attorney's statement. McClain, who also disrobed, "is accused of unsuccessfully ordering [his wife] to orally copulate both him and [the other man]," the statement added.

McClain then ordered his wife to castrate the younger man, and she "fearfully pretended to follow his instructions," the statement said. Schroeder said there were several puncture wounds in the man's groin area, including on his testicles.

After slashing the man's face with the knife, prosecutors said, McClain fled the scene, forcing his wife to go with him.

McClain then forcibly sodomized his wife, chopped off her hair with the knife, and ultimately drove her back to their Irvine home, prosecutors allege. About 5 a.m. Monday, the wife was able to leave the house with her four children and drive to a nearby hospital to get treatment, authorities said.

A cleaning crew discovered the young man in the leasing office about two hours later and called 911.

The young man's aunt, Nancy Smith, said she was stunned by what befell her nephew, an aspiring singer and songwriter who worked as a salesman at a Jos. A. Bank store in Orange County.

"I think my nephew came across pure evil," she said in a telephone interview from Florida. "It is hard to believe that there is that much anger and hate in someone."

The young man's father said earlier this week that he had warned his son about getting involved with a married woman, but that he didn't listen. The father, who visited his son in the hospital, said his son would require surgery for a "complete facial reconstruction."

Both the young man and McClain's wife remained hospitalized as of Wednesday afternoon.

The woman's sister, who drove from Arizona to take care of the couple's children, said they had been married for years and she knew of no previous trouble between them.

"I have always seen him as a good person. So this is very hard to believe. He adores his children. They were his life," said the woman, who declined to provide her name.

McClain, who worked as a guard at the county jail in downtown Los Angeles, resigned from the Sheriff's Department Wednesday afternoon, said Steve Whitmore, a sheriff's spokesman. McClain had not had any disciplinary problems since graduating from the Sheriff's Academy in March, Whitmore said.

McClain suffered minor injuries in the attack and will be arraigned at the Harbor Justice Center in Newport Beach when his medical treatment is completed, prosecutors said. He is being held in lieu of $1-million bail.

That's terrible. It's obvious this guy snapped. Even the woman's sister stated that he was a good guy.

This must really suck for their 4 kids.

Wake up....it doesnt happen......

We have almost 10K sworn.....as much as ALL of the other SoCal agencies (except for LAPD and CHP) COMBINED........2K of those (including this guy) were hired in the last 30 months.......more than a couple of bad apples are going to slip through.......

Hopefully, we didnt hire a Rafael Perez or someone like him in this bunch.....

You probably need to delete SBSD, SDSD, RSO, LBPD, SDPD, and several others for your post to work.

sorry....should have said 'LA County' instead of SoCal....since I guess the IE is part of it......in some peoples minds....:D

and LBPD only has around 2K sworn....if that.....

somebody added up all the agencies in the LA area awhile back.....we had 10K, LAPD had around 10K, and all the others added up to ALMOST 10K......most agencies are under 200 sworn.....about the size of one of our medium sized stations.....

No. Should they have caught the one that made his wife and her lover strip down and try to force them into a threesome right before he forced her to try to castrate the lover? Uhh, yeah. I'm thinking a good written and interview with the shrink should be able to catch some of that vibe.

More time in backgrounds/less time selling out to TV producers = less partially castrated citizens.:)

During the big hiring push (when this guy got hired) the BI were getting pushed to get the BI done asap......

The written psych is the same as every other agency uses....the MMPI.....

somehow, I think this guy would have gotten through pretty much any screening......I worked with more than a few that had anger management issues.....not exactly uncommon in LE work......

Some get screened out in the hiring process.....others take more time to step on themselves........I can think of 4 that got arrested for major stuff at the station I worked......none of which hit the news......

It's not just the hiring process. Sometimes good cops can turn bad. I heard the service really gets into people and either changes them for the better or far worse.

I can already notice the differences in the people in my academy.

but He did resign but I'm guessing he has a no rehire mark in the file. :rolleyes:

Not that it is a rare name, but wasn't there a Recruit in the T.V show The Academy named McClain? The same TV show that films at the LA sheriff academy where this fool would have gone?

I'm gonna watch it again to see if he is in it.

This guy was in class 368, which was the subject of Season 2 of the TV show......I dont remember him being shown, but he was there......

I had a feeing, being on probation it made sense he was on one of the two seasons of the show.

You DO realize that around 18 classes have graduated since 355 (class in first season)?.......which means that around 1200 or so Deputies are also on probation?

But you implied it. You're reaching by saying that it makes sense that he was on the show simply because he was on probation. Of the deputies currently on probation, a small fraction were on the show.

As a BI I would freak if someone I signed off on did something like this, but all the other guys tell me it's just a matter of time. All we can do is find out what the guy has done in the past, I assume he wasnt making a habit out of this.

I wonder if his BI talked to any ex-girlfriends? I like to do that, if there is anyone who will trash talk, its them.
