Anyone have an idea what the top 10 citable misdemeanors are in CA?

I'd have to say the top 3 are:

1) CVC 12500(a,) unlicensed driver
2) CVC 23222 (b,) Marijuana in a vehicle
3) HS 11357(b,) Possession of less than one ounce of Marijuana
followed up by any misdemeanor a minor commits.

I'd add:

14601.1(a)/14601.2(a) CVC - Suspended License
35550 CVC et al - Weight limit violations (OK, showing my geek commercial enforcement side)

Other than those, I think the first 3 are pretty much dead-on....

I think the 12500 and 14601 answers given are pretty dead on. There are so many thousands of those written its not funny.

I think it depends on where you work. I don't 647f because we can put them in jail for it. I need to find a friend of theirs to take responsibility. I think the 1st 4 are on the money. I can't tell you abotu the weight limit thing. I also cite minors alot for MIP.

rough order of mine..

484a PC- Petty theft.
14601-et al. --- I do take a lot to jail though.
647(e)- Illegal lodging
11364 HS- Drug paraphernalia
4140 BP- poss hypo needle
485a ? PC- For transients with a shopping cart
11357(b) HS- and the above noted CVC version.
A muni code for alcohol consumption in public.
The CVC for false registration tabs.


12500a I cite as an infraction (though I know it can be a misdemeanor too).. but it would be by far and above the top one here (Mexicans without CDL's account for most of those).

Cites for 647(f)? That's odd... I've never heard of that being done.

How do you get around the requirement of 647(g) though?

647(g)When a person has violated subdivision (f), a peace officer,
if he or she is reasonably able to do so, shall place the person, or
cause him or her to be placed, in civil protective custody. The
person shall be taken to a facility, designated pursuant to Section
5170 of the Welfare and Institutions Code, for the 72-hour treatment
and evaluation of inebriates. A peace officer may place a person in
civil protective custody with that kind and degree of force which
would be lawful were he or she effecting an arrest for a misdemeanor
without a warrant....

We can argue it is not reasonable for us due to our local jail not accepting these bookings.

At my dept we cite everyone for 12500, even if they are really 14601.

I have never seen someone get cited for 647(f.)

Is that because the D.A. won't file a 14601, or the politics of your Department, or some other reason?

Do you guys get to impound per 14602.6(a) VC? Although the 12500(a) is a misdemeanor, our local courts file & dispo it as an infraction. The 14601's are handled flat out as misdemeanors. Just curious...
